Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the site for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, scrape, or attempt to extract the source code of the site, except to the extent that such restriction is prohibited by applicable law.
You can browse, complete onboarding, play the free deck, and purchase a subscription as a guest, with no account — your unlock applies directly to your browser. Creating an account (via Google, Apple, or a one-time email link) is optional, and only needed if you want your unlock and custom packs to follow you across devices. You are responsible for maintaining access to your sign-in method (your Google/Apple account or your email inbox) and for all activity under your account. Notify us at talkcards.support@gmail.com if you believe your account has been accessed without authorization.
The site offers premium content through auto-renewing subscription plans (for example weekly and yearly), sold by us and processed by Stripe, our payment processor.
If you are a consumer in the EEA or UK, you generally have a statutory right to withdraw from an online purchase of digital content or services within 14 days, without giving a reason. However, by starting a subscription or free trial, you expressly request that we begin providing the service immediately, and you acknowledge that your right of withdrawal is lost once the digital content or service has been fully supplied, to the extent permitted by applicable law. Nothing in these Terms limits any mandatory consumer right you may have. To request a refund or exercise a withdrawal right, email talkcards.support@gmail.com.
The site lets you create custom packs and write your own questions ("Your Content"). Your Content is stored on our servers (tied to your guest session or account) so it can follow you across devices once you sign in.
You agree not to: use the site for any unlawful purpose; interfere with or disrupt the site or its security; attempt to gain unauthorized access to any system; scrape or bulk-extract content; or use the site in a way that infringes the rights of, or restricts the use of the site by, any third party.
The site and all content we provide — including questions, packs, text, graphics, illustrations, logos, and design — are owned by us or our licensors and are protected by intellectual-property laws. Except for the licence granted above, no rights are transferred to you.
TalkCards provides conversation prompts and games for entertainment and personal enrichment only. It does not provide professional, medical, psychological, therapeutic, or relationship advice, and is not a substitute for the services of a qualified professional. You are responsible for how you use the prompts. If you are experiencing distress or relationship difficulties, please consult a qualified professional.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content or your misuse of the site or violation of these Terms.
We may suspend or terminate your access to the site if you breach these Terms or use the site unlawfully. You may stop using the site at any time; email talkcards.support@gmail.com to request deletion of your account. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
We may modify or discontinue the site or any feature at any time. We may also update these Terms; when we do, we will revise the "Last updated" date. For material changes we will provide notice reasonably in advance where required by law. Changes will not reduce accrued subscription rights or mandatory consumer rights. Your continued use of the site after non-material changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the country in which the Owner (Individual entrepreneur Volha Budzko) is established, without regard to its conflict-of-law rules. Mandatory consumer-protection rights available to you in your country of residence are not affected. Where permitted, disputes will be subject to the competent courts of the Owner's place of establishment.
Signing in with Google or Apple, and paying via Stripe, are each governed by that provider's own terms of service, in addition to these Terms. We are not responsible for those providers' services, availability, or terms. The site is not distributed through the Apple App Store or Google Play — it is a website, and no app-store reseller terms apply to it.
